While we anticipate that your trip will be free from complications, by signing below you acknowledged that there are inherent risks associated with outdoor activities, including but not limited to camping, hiking, swimming, bicycling, climbing, and all other outdoor adventures. Custom Campsites LLC and its employees, agents or contractors are not liable for personal injury, death, loss, or damage to personal belongings that may occur during your stay or participation in any activities associated with your camping experience.
Customers of Custom Campsites LLC are responsible for their own safety and wellbeing. It is your responsibility to follow all instructions and guidelines set forth by Custom Campsites LLC and the campground you have selected, to exercise all necessary precautions to ensure your own safety and take all necessary measures to protect your own property while engaged in the camping experience. The following is a list of common occurrences that may arise during your camping experience for which Custom Campsites shall not be liable, and is only meant to put you on notice of potential hazards you may encounter, but is not exhaustive of all potential dangers:
1. Personal injury: injuries sustained due to slips, falls, trips, or accidents while hiking, climbing, or engaging in recreational activities.
2. Property damage: damage to camping equipment, facilities, vehicles, or surrounding natural areas, which may result in liability for repair or replacement costs.
3. Wildlife encounters: injuries or damage resulting from encounters with wildlife, including but not limited to bites or property damage.
4. Fire hazards: liability for causing wildfires due to improper campfire management or leaving cooking equipment unattended.
5. Water accidents: injuries or drownings that occur while swimming, boating, or fishing in lakes, rivers, or bodies of water.
6. Waterborne diseases: disease or illness caused by waterborne microscopic organisms that may be ingested or contracted by exposure during water-related activities.
7. Food-related illness: illness or disease arising from the consumption of improperly stored or prepared foods, or the consumption of wild-caught fish or game.
8. Equipment malfunction: injuries or damage resulting from the use of faulty camping equipment such as tents, stoves, or generators, or the misuse of these items.
9. Weather-related risks: injuries or damage due to severe weather conditions such as storms, flooding, or extreme temperatures. Custom Campsites will not issue refunds due to inclement weather conditions that occur during your camping experience.
10. Negligence claims: claims arising from failure to adequately supervise children or others in the camping area leading to accidents or injuries, or the failure to adhere to campground rules and regulations that result in accidents or injuries.
11. Trespassing: liability issues arising from entering private land without permission.
12. Environmental damage: liability for harming the local environment, including but not limited to flora and fauna, which may result in fines or penalties.
13. Lost or injured pets: liability for injuries caused by pets to other campers or wildlife, as well as the costs associated with searching for lost pets, or injuries to your pets caused by wildlife or other campers pets.
14. Inadequate first aid responses: liability stemming from providing insufficient medical assistance in case of an injury or emergency.
15. Alcohol-related incidents: injuries or damage resulting from the consumption of alcohol while camping, including but not limited to reckless behavior, exacerbation of medical conditions, or alcohol poisoning.
The foregoing list is meant to assist you in recognizing potential liabilities and to help you take the necessary precautions to ensure a safe and enjoyable camping experience. By selecting yes, this indicates you understand that there are inherent risks and liabilities associated with the camping experience, and you agree to indemnify and hold harmless Custom Campsites LLC if any accidents, injuries, damages, or losses occur.
In addition to releasing Custom Campsites LLC from liability as described above, you also agree that if any property or equipment of Custom Campsites LLC is damaged during your stay, you will be responsible for the costs associated with repairing or replacing the item, with the exception of items damaged by acts of God or circumstances outside of your control such as severe weather, earthquakes, or riots.
This general release is not intended to be limited by the liabilities identified herein. By using our services, you release Custom Campsites LLC, its agents, employees, contractors, and affiliates from any and all liability for accidents, injuries, damages, or losses that may occur that are not due to negligence by Custom Campsites LLC. I have read and understand the above policies regarding liabilities and agree to indemnify and hold harmless Custom Campsites LLC, its agent, contractors, and affiliates for any accident, injury, damage, or loss that may arise during my camping experience.
